Notice of CBP to Strictly Enforce $800 de minimis Rule

  • Starting from January 11, 2025, U.S. Customs and Border Protection (CBP) will begin strictly enforcing Section 321 - the De minimis Rule, which allows for the duty-free import of up to $800 in goods per importer per day. At the same time, the CBP system will be updated to identify importers who do not comply with the rule, applicable to all modes of transportation.

     

     

    Warm tips:

    1. Conditions apply to the De minimis Rule:

    (1) The value of the goods do not exceed $800;

    (2) The shipment must be imported by one person (or company) on one day; (regardless of mode of transportation or type of entry);

    (3) Consolidated shipments addressed to one (ultimate) consignee shall be treated as one importation;

    (4) The importer must declare the value of the goods on a bill of lading or similar document such as a manifest.

    (5) This Rule applies to all modes of transportation, carriers and all types of entry.

     

    2. If this limitation is exceeded, please pay attention to:

    The goods may be required to be imported by formal entry or informal entry, subject to CBP’s discretion, at that time, you will be needed to provide customs declaration documents and pay duty, taxes and fees.

     

    Shipments found with declaration details omitted or altered with intent to avoid the daily threshold may result in potential customs clearance holds or delays in delivery, and additional charges may be incurred.
