Full Implementation of Section 321 de minimis rule by U.S. Customs Starting January 11, 2025

        The U.S. Customs and Border Protection (CBP) will fully implement Section 321, the “de minimis rule,” starting Saturday, January 11, 2025. Under this rule, CBP will identify importers who fail to comply and may detain or delay clearance of their shipments. Below are the conditions applicable to the “de minimis rule”:

    1. Shipments with a value below USD 800.
    2. The USD 800 exemption applies to a single import for the same recipient or recipient company on the same day.
    3. Shipments for the same importer, regardless of transport method, are considered a single import. If the total value exceeds USD 800, a taxable import declaration is required.

        For example, if a recipient imports two low-value shipments under USD 800 on the same day through the JFK and LAX ports, CBP’s system will consolidate these shipments. If the combined value exceeds USD 800, duties will be assessed per local regulations.

     

    Key Notes for Exceeding the Daily Threshold:

    • Shipments exceeding the daily limit may require formal or informal entry clearance at CBP’s discretion. Brokerage fees may be charged by our company, and applicable duties and taxes will be collected by customs.
    • All formal entries are subject to the Customs Merchandise Processing Fee (MPF). This fee is payable by either the shipper or the consignee, depending on the terms of the shipping document, and will be reflected in the corresponding invoice.
    • Any deliberate omission or falsification of declared values to circumvent the daily limit may result in shipment detention or clearance delays.
